Terms and Conditions for Buying Research Peptides in Australia

In these terms, "we", "us" and "our" mean that business, and "you" means the person or organisation placing an order. By placing an order you agree to these terms, our Research Use Policy, our Shipping Policy, our Refund Policy and our Privacy Policy.

About these terms and our products

Macropus Peptides sells research peptides and related laboratory supplies within Australia. Every product is supplied strictly for in-vitro laboratory research. Nothing we sell is a medicine, a therapeutic good registered for supply in Australia, a food, a supplement or a cosmetic, and nothing is sold for use in humans or animals.

Product descriptions on this website describe compounds and their labelled specifications. They are not claims that a product treats, prevents or cures any condition, and they must not be read that way.

Eligibility and age

You must be at least 18 years old to create an account or place an order. By ordering, you confirm that:

you are 18 or older;
you are purchasing for a legitimate in-vitro research purpose, either for yourself as a qualified researcher or on behalf of an organisation that has authorised the purchase;
you have the knowledge and facilities to handle, store and dispose of the products safely; and
the information you give us is true and complete.

We may ask for evidence of age, identity or research purpose at any time. If we cannot verify these details to our reasonable satisfaction, we may decline or cancel the order.

Your research use warranty

You warrant that products bought from us will be used only for in-vitro laboratory research and will not be administered to any person or animal, sold as a medicine or supplement, or resupplied to anyone who intends to use them that way. You also warrant that you have checked the regulatory status of each product for your organisation and your state or territory.

The scheduling of substances in Australia is set by the Therapeutic Goods Administration (TGA) through the Poisons Standard, and state and territory laws control how scheduled substances may be bought, held and used. You are responsible for confirming that your purchase, possession and use of each product is lawful for you and your organisation, including any licence or permit you may need. Orders and acceptance

Placing an order is an offer to buy. A contract is formed only when we accept your order, which happens when we dispatch the goods or send you a dispatch confirmation. An order acknowledgement email only confirms that we received your order.

We may refuse or cancel any order, in whole or in part, before dispatch, including where:

we reasonably believe the product may be used for human or veterinary purposes;
you ask for dosing, administration or similar advice;
the order appears fraudulent or payment cannot be verified;
a product is out of stock or has been withdrawn; or
the order contains a pricing or description error.

If we cancel an order you have paid for, we will refund the amount paid for the cancelled items.

Pricing and errors

Payment

You must provide a complete and accurate delivery address. We are not responsible for delays or losses caused by an incorrect address you supplied.

Returns and refunds

Returns, replacements and refunds are handled under our Refund Policy. Because the integrity of research peptides depends on storage conditions, opened products and products that have left our control and may have been exposed to unsuitable temperatures cannot be returned for change of mind. This does not limit your rights where a product is faulty, damaged or not as described.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded or limited.

Limitation of liability

To the extent permitted by law, and subject to the section above:

we exclude all conditions, warranties and guarantees that would otherwise be implied into these terms;
where the goods are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, or paying the cost of replacement or of acquiring equivalent goods;
we are not liable for any indirect or consequential loss, including loss of research data, lost time or failed experiments; and
we are not liable for any loss arising from use of a product contrary to these terms, the product label or our Research Use Policy.

You indemnify us against any claim, loss or cost arising from your breach of the research use warranty in these terms, to the extent that the claim, loss or cost was caused by that breach.

Intellectual property

The content of this website, including text, product photography, label designs, the Macropus Peptides name and the kangaroo peptide mark, is owned by or licensed to us. You may view and print pages for your own reference. You must not copy, reproduce or republish our content for commercial purposes without our written permission.

Privacy

We collect and handle personal information as described in our Privacy Policy.

Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that may hear appeals from them.
